Terms and conditions

These terms govern use of the Kastovia website and general pre-engagement communications. A written proposal, order form, statement of work, invoice, or contract governs a paid engagement and controls if it conflicts with these website terms.
1. Company
Kastovia Holdings LLC is a limited liability company registered in Georgia. Registered office: Lochini 3, Apt. 5, 0100 Tbilisi, Georgia. Contact: contact@kastovia.com.
2. Website use
This website is provided for general information. You agree not to misuse it, interfere with its operation, attempt unauthorized access, or use it for unlawful purposes.
3. No automatic engagement
Visiting the website or sending an enquiry does not create a service relationship. Work begins only after scope and commercial terms are agreed in writing.
4. Business customers and payment
The Automation Profit Audit and B2B services are offered for business or professional use. If you may be acting as a consumer, contact Kastovia before paying. Payment is requested only after scope fit is confirmed; applicable taxes, currency, payment method, and any processor charges are disclosed before payment. Work begins after cleared payment and receipt of the agreed kickoff information.
5. Automation Profit Audit
The €490 audit covers one confirmed workflow and the four written artifacts plus executive readout stated on the offer page. The five-business-day period begins after scope confirmation, cleared payment, and receipt of the agreed kickoff information. Implementation, subscriptions, multiple unrelated workflows, and guaranteed savings are excluded unless separately agreed.
6. Scope changes, cancellation, and refunds
Material scope changes require written agreement and may affect fees or timing. Before analysis begins, a paid audit may be cancelled for a refund, less non-recoverable payment charges where permitted. Once analysis begins, the audit fee is non-refundable except where required by law or agreed in writing. If Kastovia cancels before completion for reasons not caused by the client, Kastovia will refund the portion paid for work not delivered.
7. Proposals and client responsibilities
Any proposal, estimate, timing, or recommendation is subject to discovery, technical feasibility, capacity, and written confirmation. Clients are responsible for accurate information, timely feedback, necessary approvals, lawful access, and materials required for the agreed work. Delays or incomplete information may affect timing and findings.
8. Confidentiality and access
Confidentiality, data handling, and system access requirements should be stated in the engagement agreement. Clients should not send passwords, access tokens, customer records, or protected datasets through an initial form or ordinary email. Any access must be lawful, authorized, limited, and separately coordinated.
9. Intellectual property
Ownership and licence rights for deliverables, software, designs, documentation, and source materials are defined in the relevant engagement agreement. Kastovia retains its pre-existing methods, templates, know-how, internal tools, and general expertise unless agreed otherwise.
10. Third-party services
Work may involve third-party platforms, APIs, hosting, software, analytics, app stores, or automation tools. Kastovia is not responsible for their outages, policy changes, pricing changes, account restrictions, or service limitations.
11. No guaranteed results
Kastovia does not guarantee revenue, savings, rankings, AI citations, downloads, approvals, or other commercial outcomes unless expressly agreed in writing. Estimates depend on stated inputs and assumptions.
12. Liability
To the maximum extent permitted by applicable law, Kastovia is not liable for indirect, incidental, consequential, special, or punitive damages. Kastovia's aggregate liability arising from a paid engagement is limited to the fees paid for that engagement, except where liability cannot legally be excluded or limited, including where applicable for fraud, wilful misconduct, gross negligence, death, or personal injury.
13. Governing law and disputes
Unless a separate written agreement states otherwise, these terms and non-contractual disputes arising from them are governed by the laws of Georgia, without overriding mandatory protections that apply by law. Subject to any mandatory forum, the courts of Tbilisi, Georgia have exclusive jurisdiction.
